BENTON, Ark. (KTHV) – Benton police said a man shot at his brother during an argument and is now in custody.

According to Lt. Kevin Russell, the shooting happened around 9:47 p.m. April 15 on the 800 block of South Main Street. Thomas Garrett, 35, of Benton, was arrested and charged with aggravated assault on a household family member, public intoxication, and discharging a firearm inside city limits.

While witnesses did say the victim was injured, he was found with no apparent injuries. He has been charged with public intoxication.

Police said Garrett appeared to be "under the influence of an intoxicating beverage."

According to the report, a double barrel 12-gauge shotgun was located at the scene and was seized for evidence.

Both brothers were taken to the Saline County Detention Facility for processing.
